Summary
This affidavit damages of may be filed by a landlord/plaintiff in a Florida eviction action that is requesting that final judgment be entered against the defendant/tenant following its failure to respond to the plaintiff's complaint for damages. This template contains practical guidance and drafting notes. This template may be used in a commercial or residential eviction. If the defendant in an eviction action fails to answer a complaint for damages within 20 days of service, the plaintiff may file the return of service for any party that is an individual along with a motion for entry of default. After the default is obtained, the plaintiff may make a motion to obtain a final default judgment. Fla. R. Civ. P. 1.140(a)(1). An affidavit of damages, setting forth the damages due to the plaintiff, must be filed with this motion.
