Summary

This affidavit for claim may be used in Ohio by any person who performed labor or work or furnished materials on improvements to real property for the benefit of public authority, as defined in Ohio Rev. Code Ann. § 1311.25. This template contains practical guidance and drafting notes. This template should only be used in connection with public improvements. To fully preserve claims, the affidavit must be properly served and filed by a subcontractor, materialperson, or laborer who has furnished labor or material in the construction of a public improvement. The purpose of the affidavit is to notify the appropriate contracting public authority, as well as other subcontractors, materialpersons, and laborers, of the amount due and unpaid for the labor and materials provided.
