Affidavit (Substitutional Service) (AB)
Summary
This precedent is a standard affidavit of the plaintiff on an application for validation of service pursuant to r. 11.27 and substitutional service pursuant to r. 11.28 of the Alberta Rules of Court, Alta. Reg. 124/2010 ("Rules"). This precedent contains practical guidance, drafting notes, alternate clauses, and optional clauses. Evidence on a motion is typically presented by way of an General Affidavit (Form 49) (AB). An affidavit is a sworn or signed and acknowledged document that sets out the facts within the personal knowledge of the deponent or facts that are within the information and belief of the deponent (Rules, r. 13.18).
