Summary
This template affidavit is for use in Massachusetts state court civil litigation. Affidavits have numerous uses in litigation, but most often are filed in support of motions (such as motions for summary judgment, attachment of property, preliminary injunctions, etc). This template contains practical guidance, drafting notes, and alternate and optional clauses. An affidavit is a written statement of facts that the affiant (person signing the affidavit): • Has personal knowledge of –and– • Swears to under oath An affidavit is signed under the pains and penalties of perjury. When you file an affidavit in support of a motion, you must serve it with the motion. Mass. R. Civ. P. 4(c).
