Summary
This precedent sets out a trustee's administrative powers for an inter vivos trust. It includes practical guidance and drafting notes. The administrative powers of trustees conferred by statutory law in British Columbia are in many respects unsatisfactory. The challenge in drafting administrative provisions is to give maximum flexibility to the trustee without including "everything but the kitchen sink". The aim of the administrative provisions in this precedent is to give maximum flexibility to the trustee without being overly general. It is hard to predict exactly what powers trustees will need because trustees in different circumstances need different powers.
