This 90-day notice of intent to file eviction action and demand for possession may be used in an Illinois eviction action where the tenant has a lease that meets the criteria for a bona fide lease under Illinois law or under the Federal Protecting Tenants at Foreclosure Act. Under Illinois law, residential tenants leasing foreclosed property from the former owners may be entitled to remain in the property until the end of their lease term and are entitled to a written 90-Day Notice from the new owner before an eviction lawsuit can be filed against them, but only if their lease meets certain legal criteria found in the 735 ILCS 5/9-207.5 This template should not be used if the occupants have no lease or if they have a lease that does not meet the criteria for a bona fide lease under Illinois or Federal law.
