Summary

This 90-day notice may be used in Florida to inform a residential tenant that due to the transfer of ownership of the property following foreclosure, his or her rights under any lease with the prior owner of the property have been extinguished and he or she can no longer occupy the property. This template contains practice guidance and drafting notes. Florida's Protecting Tenants at Foreclosure Act (PTFA) provides that a bona fide tenant may remain in possession of the property for 90 days after notice from the new owner of the termination of the lease due to the foreclosure.
