1550 LAUREL OWNER'S ASSOCIATION, INC., Petitioner, v. APPELLATE DIVISION OF THE SUPERIOR COURT OF LOS ANGELES COUNTY, Respondent; STEPHEN MUNSHI, Real Party in Interest., 28 Cal. App. 5th 1146

Summary

HOLDINGS: [1]-In a limited civil case in which petitioner sought a writ of mandate directing the appellate division to vacate its order, which granted a petition for writ of mandate and directed the trial court to rule on the merits of an anti-SLAPP motion, the appellate court concluded that the restrictive language of Code Civ. Proc., § 92, subd. (d), which limits the type of anti-SLAPP motions that may be brought in a limited civil case, precludes the filing of an anti-SLAPP motion in such a case; [2]-The legislature declined to add language either to § 92 or to § 425.16 to expand the range of anti-SLAPP motions that are allowed in limited civil cases; [3]-By refraining from doing so, the legislature authorized anti-SLAPP motions to be filed in unlimited civil cases, but left unchanged § 92, subd. (d)'s restriction on anti-SLAPP motions that may be brought in limited civil cases.
