Summary

This 10-day notice to quit may be used by a Pennsylvania landlord to provide a residential or commercial tenant with the statutorily required 10-day notice prior to instituting an action for eviction following a tenant's failure to pay rent. This template contains practical guidance, drafting notes, and alternate and optional clauses. Eviction actions in Pennsylvania are governed by the Landlord and Tenant Act of 1951 (Act), 68 Pa. Stat. Ann. § 250.101 et seq. Before a landlord may begin an eviction action to remove a tenant and recover possession of leased premises, the landlord is required to serve the tenant with written notice to quit. Notice requirements vary depending on the reason for eviction. This 10-day notice to quit is used to evict a tenant for failure to pay rent. See 68 Pa. Stat. Ann. § 250.501(b). A 10-day notice may also be used if the tenant's lease is being terminated and the tenant evicted for the use or sale of illegal drugs on or from the premises. See 68 Pa. Stat. Ann. § 250.501(d) and 68 Pa. Stat. Ann. § 250.505-A. Longer notice requirements apply to monetary and nonmonetary defaults by a mobile home tenant. See 68 Pa. Stat. Ann. § 250.501(c).
