Summary
When there is a will but no executor qualifies, letters of administration cum testamento annexo (c.t.a.) may be granted to the person or persons entitled thereto. 20 Pa. Cons. Stat. Ann. § 3158. The practitioner should always obtain the renunciation of those who have an equal right to serve. Some county rules require renunciation to be notarized.
When a vacancy occurs in the office of personal representative before administration is completed, the register, in a case of intestacy, shall grant letters of administration de bonis non (d.b.n.), and in a case of testacy, letters de bonis non cum testamento annexo (d.b.n.c.t.a.), to the person or persons entitled thereto. 20 Pa. Cons. Stat. Ann. § 3159.
