- [1] Purpose
The Florida Construction Lien Law (“the Act”) [§ 713.001, Fla. Stat.; see §§ 713.01–713.37, Fla. Stat.] establishes procedures that a contractor, subcontractor, materialman, or laborer may follow to obtain a lien on real property for money due and owing for labor, materials, or services used to improve the property [§ 713.01(25), Fla. Stat.]. The Act prescribes detailed procedures for obtaining liens and delineates who is entitled to the liens [§ 713.02, Fla. Stat.]. The Act also provides notice and payment procedures that the owner of real property must follow in order to ensure that his or her liability for the costs of any improvement to the property is limited to the contract price [§§ 713.06(3), 713.13, Fla. Stat.].
