Summary

This is a strict compliance service statute. The practitioner should be alert to County administrative codes that may conflict with CPLR 311 provisions. In the event of inconsistent service directives, the CPLR will govern but compliance with the county procedure is preferable.1

Service on a corporation may also be made pursuant to BCL § 306 and BCL § 307. The former applies to domestic or foreign corporations licensed in New York. The latter is applicable to unlicensed foreign corporations and has been strictly construed by the Court of Appeals.2
