Summary
One of the two most frequently applied statutes of limitation is that found in CPLR 213. The six-year statute applies to many commercial transactions and accordingly, business practitioners must be respectful of its provisions.
Initially the section provides that on those occasions when a specific period of limitations is not provided by statute, the six-year period will apply. Thus, it has been held that actions for specific performance, claims of negligent misrepresentation, and assertions of constructive fraud are governed by CPLR 213.1
