A tenant’s offer of a surrender is traditionally effected by vacating the premises and returning the keys to the landlord. A tenant may also surrender possession by an unequivocal writing. Where a settlement of a proceeding involves the tenant’s surrendering possession of the premises in exchange for some form of consideration, the negotiated surrender will typically involve the tenant’s turning over the keys, along with a signed acknowledgment of surrender.
