- [1] Comment—Use of Form
The following form may be used to request the ancillary probate of a foreign will that has already been admitted to probate in the decedent’s domiciliary jurisdiction.1
The application must be accompanied by a copy of the will and a copy of the judgment, order, or decree admitting the will to probate or otherwise establishing it. These copies must have been attested by and with the original signature of the clerk of the court or their official custodian. If the court has a seal, the court’s seal must be affixed to the copies. In any event, the copies must be accompanied by a certificate containing the original signature of the judge or presiding magistrate of the court that the attestation is in due form.2
