TRACY SEMPOWICH, Plaintiff — Appellant, v. TACTILE SYSTEMS TECHNOLOGY, INC., d/b/a Tactile Medical, Defendant — Appellee, EQUAL EMPLOYMENT OPPORTUNITY COMMISSION, Amicus Supporting Appellant., 19 F.4th 643

Summary

ISSUE: Whether an employer was properly awarded summary judgment on a former female employee's discrimination, retaliation, and Equal Pay Act claims. HOLDINGS: [1]-Because the trial court erred in holding that there were no genuine issues of material fact precluding summary judgment on the employee's claims of disparate treatment and retaliation under Title VII of the Civil Rights Act of 1964, the appellate court vacated the trial court's judgment as to those claims and remanded those claims for further proceedings; [2]-Because the trial court applied an incorrect legal standard to the employee's Equal Pay Act claim under 29 U.S.C.S. § 206(d)(1) when the court found that total wages rather than the wage rate was the proper metric, the appellate court vacated the trial court's judgment as to that claim and remanded that claim for further proceedings.
