HOLDINGS: [1]-Non-profit organizations that provided workplace diversity training had standing to bring a pre-enforcement challenge to an executive order that prohibited federal contractors from promoting specified concepts in such trainings. Evidence of intent to enforce was shown by the fact that the government had set up a hotline for reporting race and sex stereotyping and scapegoating, as well as an email address where complaints could be sent; [2]-The court enjoined enforcement of the executive order because the organizations were likely to succeed on the merits of their First Amendment claim, given that the order restricted use of a contractor’s own funds, to train its own employees, on matters that potentially had nothing to do with the federal contract; [3]-The executive order was so vague that it was impossible for the organizations to determine what conduct was prohibited.
