Summary

This e-discovery fundamentals presentation is a model presentation in-house or outside counsel can use to train others on the fundamentals of e-discovery in a federal court litigation. It covers topics such as preserving electronically stored information (ESI), including understanding proportionality, issuing a litigation hold, and avoiding spoliation and sanctions; preparing document requests and responses, including objecting to requests, locating and producing ESI, and metadata issues; and addressing additional ESI issues such as cost-shifting and privilege concerns.
