Representing Debtors


Summary

This practice note discusses representing debtors in the pre-bankruptcy period and certain general bankruptcy concepts. Bankruptcy practice is complex, technical, and often counterintuitive. It is easy for nonspecialist attorneys to make mistakes, many serious. Thus, when a client informs counsel that it is near default or insolvency, most business attorneys will either refer the matter to attorneys who specialize in bankruptcy practice, or at least co-counsel with them if that is acceptable to the client.
