Summary

Insurers issuing policy forms that are subject to form filing requirements may, notwithstanding such requirements, use the forms prior to filing them based on a variety of exceptions depending on the jurisdiction and the nature and size of the risk being insured. As discussed further in the following subsections, many states have laws that explicitly exempt certain risks from form filing requirements based on the size of the policyholder. Such laws are often referred to as “industrial insured” exemptions or apply to “large commercial risks,” many of which were promulgated in response to a movement for deregulation of commercial lines’ insurance policies advanced by the National Association of Insurance Commissioners in the late 1990s.1William R.
