Stored Communications Act (SCA): Practical Considerations


This practice note provides guidance on how to apply the Stored Communications Act (SCA), 18 U.S.C. § 2701 et seq., to today’s fast-growing technology. The SCA governs the disclosure of electronic communications stored with technology providers. Passed in 1986 as part of the Electronic Communications Privacy Act (ECPA), the SCA remains relevant to address issues regarding the privacy and disclosure of e-mails and other electronic communications.
