This escrow instructions template provides written instructions to the escrow holder or agent about the steps to be taken to close a particular real estate transaction, and is written from the point of view of the buyer's counsel. This template includes practical guidance, drafting notes and optional clauses. This template incorporates California law. While this template reflects the point of view of the buyer's counsel, and the more extensive requirements for buyers compared with sellers, this template can be easily adapted to be from the seller's counsel. Sometimes purchase agreements will include escrow instructions and require that the escrow holder sign the purchase agreement to acknowledge its duties.
