Summary

This template COBRA unavailability notice is used to inform individuals that COBRA continuation coverage under an employer-provided group health plan is not available to them for a specified reason, as required under 29 C.F.R. ยง 2590.606-4(c). This template includes practical guidance, drafting notes, and alternate and optional clauses. A plan administrator that receives notice of certain so-called first qualifying events, a second qualifying event, or a determination of disability on behalf of a potential COBRA qualified beneficiary has 14 days to notify them of their COBRA rights. This template, which contains alternate clauses to address each of these scenarios, is used when COBRA coverage (or an extension of COBRA coverage) is not available.
