Summary

This Texas medical power of attorney template provides the means for a principal to designate a health care agent to make medical and health care decisions on behalf of the principal should the principal become unable to make such decisions (as certified by the principal's physician). This template includes practical guidance, drafting notes, and alternate and optional clauses. This statutory template comports with the requirements for a medical power of attorney under Tex. Health & Safety Code § 166.151 et seq and substantially follows the statutory form found at Tex. Health & Safety Code § 166.164. Any limitations on the health care agent's powers should be specifically set forth in the document. Unless it provides for a shorter duration, the medical power of attorney will last indefinitely until it is revoked by the principal.
