This template is a statutory, durable power of attorney for use in Texas. Use this template to grant an attorney-in-fact the power to make decisions with respect to the principal's property and finances. This template includes practical guidance, drafting notes, and alternate and optional clauses. This template is based on the statutory, durable power of attorney language found at Tex. Est. Code ยง 752.051, and also includes non-statutory, optional provisions customarily found in Texas power of attorney forms. The template grants the specified agent broad powers to conduct the financial affairs of the principal. The template also includes special instructions applicable to the agent's power to grant gifts from the principal's property and agent compensation. It can either go into effect immediately upon execution or serve as a springing power of attorney that becomes effective only upon the principal's incapacity.
