Online Negative Option Marketing Checklist

Summary

This checklist provides guidance for compliance with online negative option marketing regulations. Negative option marketing is a type of commercial transaction where the seller/marketer interprets a consumer's failure to affirmatively reject an offer or cancel an agreement as assent to enter into or continue in the agreement, and to ultimately be charged for the goods or services at issue. In such plans, a consumer's silence in response to an offer is considered acceptance. This is in contrast to most commercial transactions, where a consumer's silence is considered a rejection of the seller's offer.
